Wills

The premier probate court in Scotland was the Commissariot of Edinburgh which had ultimate jurisdiction over all other Scottish courts (and over the wills of testators dying abroad). As with the Prerogative Court of Canterbury in England and Wales, wills may have been proved in this higher court rather than the local one. The old Commissariot jurisdictions detailed below continued until 1823 except for Edinburgh which continued its local jurisdiction over the Lothians until 1830.

The Library contains film copies of indexes to wills proved at the Principle Probate Registry 1858-1930 and indexes, calendars and many abstracts of wills proved by individual church courts before 1858. Details, correct as of 1996, are published in:
